Today we take a closer look at recent events that highlight the importance of protecting your personal information. The Office of the Data Protection Commissioner (ODPC) has fined three companies a total of Ksh. 9,375,000 for not following the rules set out in the Data Protection Act, 2019. This shows that privacy laws are essential for any business in Kenya today. This article will explain what happened in these cases, what it means for you, and why data protection matters in Kenya.

The Office of the Data Protection Commissioner (ODPC) has issued three penalty notices totaling Ksh.9,375,000 to three companies for breaching the Data Protection Act 2019.ODPC is the regulator independently responsible for monitoring the implementation and enforcement of the law. Data Protection Act, 2019. According to a press release dated September 26, 2021, and signed by the Data Protection Commissioner, Immaculate Kassez, the three companies that received penalty notices are:

Mulla Pride Ltd: the digital credit provider (DCP) that operates the KeCredit and Faircash mobile lending apps, was the first data controller to receive a penalty of Kshs 2,975,000.The DCP was convicted of using the complainant's name and contact details obtained from a third party, which were then used to send threatening messages and phone calls.

Casa Vera Lounge: a restaurant located along Ngong Road in Nairobi.The establishment was fined Kshs 1,850,000 for posting an image of a partygoer on its social media platform without the consent of the person concerned.

Roma School: an educational institution based in Uthiru, was fined Kshs 4,550,000 for posting photos of minors without parental consent.The ODPC said the penalty notices were issued after conducting investigations and giving companies an opportunity to make representations.

ODPC also warned that it will continue to monitor and enforce the Data Protection Act 2019 and take appropriate action against any data controllers or processors that do not comply with the law.The Data Protection Act 2019 is comprehensive legislation that regulates the processing of personal data in Kenya.

The law aims to protect individuals' privacy and dignity by ensuring that their personal data is collected, used, stored, and shared in a lawful and transparent manner. The law also grants individuals various rights regarding their personal data, such as the right to access, rectification, deletion, restriction, objection, and data portability.

ODPC has called on all data controllers and data processors in Kenya to comply with the Data Protection Act 2019 and register with ODPC as required by Section 50 of the Data Protection Act 2019. ODPC also encourages all individuals to exercise their personal data rights and to report any suspected data breach or misuse to ODPC.
